On 20 October, IRZ continued its professional cooperation with the Jordanian Judicial Council by organising a hybrid seminar for judges from various courts in Amman and Zarqa. Judge Rami Salah of the Court of First Instance in Amman and Presiding Judge Dr Tobias Oelsner of the Berlin Regional Court explained the legal foundations of international banking and commercial transactions. The focus was particularly on issues of applicable law and international jurisdiction. The relevant legal frameworks were examined, including the German Civil Code, the Commercial Code, the Rome I Regulation and the UN Convention on Contracts for the International Sale of Goods, as well as the international rules of the International Chamber of Commerce.
Particular emphasis was placed on the practical handling and securing of international commercial transactions. Using documentary credits and bank guarantees as examples, the role of the banks involved and the specific legal features of these security instruments were discussed. The globally standardised trade clauses of the International Chamber of Commerce and their significance for the allocation of costs and risks in international goods deliveries were also addressed.
However, the resolution of disputes through the courts in international commercial transactions was also discussed at length. In this context, the structures of the German commercial judiciary were presented – ranging from the traditional chambers for commercial matters to the newly established Commercial Courts. Particular attention was paid to the organisation of proceedings and the efficient handling of complex commercial disputes. International commercial arbitration was also addressed.
The ensuing discussions provided an opportunity to compare legal practice in Jordan and Germany, particularly with regard to the legal safeguards for cross-border transactions and the various options for dispute resolution.
